RE: The tariff classification of softwood veneer from Russia

Dear Mr. Nurre:

In your letter dated August 16, 2007 you requested a tariff classification ruling.

The ruling was requested on various lumber, plywood and veneer products from Russia. The veneer will be imported in sheets of 51” x 101” and in thicknesses of 4.2 mm or thinner. The softwood (coniferous) species of veneers to be imported consist of the following: Siberian or European red pine (Pinus silvestris), Siberian larch (Larix siberica), Spruce (Picea obovata), and Siberian fir (Abies siberica).

The applicable subheading for the softwood species of veneers listed above will be 4408.10.0145, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sheets for veneering (including those obtained by slicing laminated wood) for plywood or for similar laminated wood and other wood, sawn lengthwise, sliced or peeled, whether or not planed, sanded, spliced or end-jointed, of a thickness not exceeding 6 mm: Coniferous: Other (than Douglas fir). The rate of duty will be free.

Your inquiry does not provide enough information for us to give a classification ruling for the other products. Your request for a ruling for these products should include the following additional information: For the birch and aspen veneers, please state whether or not these are spliced or end-jointed. For the lumber products, please give the dimensions these will be imported in, state whether or not these are finger-jointed or otherwise end-jointed, state whether these are rough sawn, planed or otherwise worked, and give the name of the specific species of the birch lumber. For the plywood products, please give the thickness of each outer ply, identify the species of the back ply for each of the different face plies listed (if the species of the back ply is different than the face ply of any plywood, give the grade of each outer ply, describing the grading system used), and state whether the surfaces are rough, touch sanded or fully sanded. When this information is available, you may wish to resubmit your ruling request for these products. Please submit a separate ruling request for each of the different classes of products (veneers, lumber and plywood). If you decide to resubmit your request, please include a copy of this letter.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
